1. Definitions and Acceptance
1.1“App” means the Naseem Islam mobile application (bundle / package identifier com.sakinah.sakinah), including its bundled Quran, Hadith, Tafsir, Dua, prayer-time, Qibla, Tasbeeh, Zakat, Qaida, Tajweed Coach, Kids Corner and other features, all related content, and any updates or upgrades we make available.
1.2“Publisher”, “we”, “us” and “our” mean [LEGAL ENTITY NAME], of [REGISTERED ADDRESS], the developer and licensor of the App. “You” means the individual who installs or uses the App.
1.3“Content” means all text, audio, images, data, and other material made available through the App, whether created by us, licensed from others, or submitted by users (“User Content”).
1.4“Store” means the Apple App Store or Google Play, as applicable, and “Store Provider” means Apple Inc. or Google LLC respectively.
1.5This Agreement is concluded between you and the Publisher only. It is not an agreement with Apple or Google. The Publisher, not the Store Provider, is solely responsible for the App and its Content.
1.6This Agreement should be read together with our Privacy Policy (https://www.naseemulislam.org/privacy.html), which is incorporated by reference. If you use the App under a Store’s standard end user terms, this Agreement supplements them; where the two conflict, the Store’s mandatory minimum terms prevail to the extent required by that Store.
2. Grant of Licence
2.1Subject to your compliance with this Agreement, the Publisher grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the App on devices that you own or control, for your personal, non-commercial purposes.
2.2Apple devices. The licence granted for iOS and iPadOS is limited to use on Apple-branded devices that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including any applicable Family Sharing or volume-purchase arrangements.
2.3Android devices. The licence granted for Android is limited to use on devices you own or control and as permitted by the Google Play Terms of Service, including any applicable family-library arrangements.
2.4The App is provided free of charge. No fee is charged for the licence, and there are no in-app purchases, subscriptions or advertising. Any donation described in Section 12 is entirely voluntary and does not purchase additional rights.
2.5The App is licensed, not sold. All rights not expressly granted to you are reserved by the Publisher and its licensors.
3. Restrictions
3.1You must not, and must not permit anyone else to:
- copy, modify, translate, adapt, or create derivative works of the App, except as permitted by applicable law;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the limited extent that applicable law expressly permits despite this restriction;
- rent, lease, lend, sell, sublicense, distribute, or otherwise commercialise the App or any Content;
- extract, scrape, or bulk-download the bundled databases or any Content served by our backend, or use them to build a competing product or dataset;
- remove, obscure, or alter any copyright, attribution, or proprietary notice, including the source attributions listed in Annex A;
- alter, misquote, or misrepresent the text of the Qur’an, Hadith, or any other religious Content in a way that presents your modification as the original;
- circumvent, disable, or interfere with security, moderation, rate-limiting, or access-control features of the App or our servers;
- introduce malware, or probe, scan, or test the vulnerability of the App or our systems without our prior written consent;
- use the App in violation of any applicable law, or to harass, threaten, defame, impersonate, or exploit any person; or
- use automated means (bots, scripts, crawlers) to access accounts, post Community Content, or submit reports.
4. Ownership and Third-Party Content
4.1The App, its source code, design, brand, logos, illustrations, user-interface, audio compilations, Urdu translations of duas, the Names-of-the-Prophet ﷺ compilation, and all other original material are owned by the Publisher or its licensors and are protected by copyright and other intellectual-property laws.
4.2The Qur’an. The Arabic text of the Qur’an is the Word of Allah and is not owned by anyone. We claim no ownership over it. We ask that you treat it with the reverence due to it. Our claim of rights extends only to the App’s software, presentation, and compilation.
4.3Third-party and open-data Content. Certain Content (translations, Hadith collections, Tafsir, duas, mosque data, names data, and recitation audio) is provided by third parties or open-data projects and remains subject to its own licence. These sources and their licences are identified in Annex A and inside the App under About → Sources. Your rights in that Content are limited to those granted by the applicable licence; nothing in this Agreement enlarges them.
4.4Non-commercial Content. Some Content is licensed to us on non-commercial, attributed terms. You may read and study it through the App, but you may not extract it and use it commercially. We rely on those terms remaining satisfied, which is one reason the App is free and carries no advertising.
4.5Recitation audio. Recitations are streamed from third-party servers (currently mp3quran.net) only when you choose to download a surah, and are then stored on your device for your personal use. All rights in the recitations remain with the respective reciters and rights-holders.
4.6Feedback. If you send us suggestions or corrections, you grant us a perpetual, worldwide, royalty-free licence to use them to improve the App without obligation to you. We will not publicly credit you unless you ask us to and we agree.
4.7Copyright complaints. If you believe any Content in the App infringes your rights, contact us using the details in Section 27 with enough information to identify the work and the location of the material. We will investigate promptly and remove or correct material where appropriate.
5. Religious Content — No Religious Ruling
5.1The App is a study, reference and worship-support tool. It does not issue fatwas, religious rulings, or personal religious, legal, or medical advice, and nothing in the App should be treated as a substitute for consulting a qualified scholar.
5.2Translations and Tafsir express the understanding of their authors, may differ from other published works, and are not a substitute for the Arabic original. Hadith collections include reports of differing strength, and some datasets in the App do not carry authenticity gradings. Please verify a report’s grading before relying on it.
5.3Compilations such as the Names of the Prophet ﷺ, duas, and devotional Content are provided as commonly circulated compilations and are not presented as a single scholarly-authenticated enumeration.
5.4We strive for accuracy and welcome correction reports (via the in-app report tools), but we do not warrant that the Content is complete, error-free, or agrees with any particular school of thought (madhhab) or scholarly opinion. Differences of opinion among scholars are a normal feature of the tradition and you should follow the guidance of scholars whom you trust.
6. Prayer Times, Qibla and Utility Features
6.1Prayer times, Hijri dates and Qibla are calculated on your device from your location, the calculation method and juristic settings you choose, and standard astronomical formulas. Results are estimates. They may differ from your local mosque or authority, particularly at high latitudes, during moon-sighting variations, or where device time, time-zone, or location data is inaccurate. Please confirm times with your local mosque or authority where accuracy matters.
6.2Qibla compass. The compass depends on your device’s magnetic sensor, which can be disturbed by nearby metal, magnets, and electronics, and may require calibration. Do not rely on it where it is unsafe to do so, and do not use it for navigation.
6.3Zakat and other calculators. Calculators provide general guidance based on values you enter. They are not financial, tax, or legal advice.
6.4Tajweed Coach, Qaida and learning features are aids for practice. Feedback or comparisons they provide are not a certification of correctness and are not a substitute for a qualified teacher.
6.5Notifications, exact alarms and Do Not Disturb. If you enable them, the App may schedule reminders, use exact alarms, and (on Android, with your permission) silence your device during prayer times and later restore your previous sound settings. Operating-system battery optimisation, device settings, or a low battery can delay or prevent reminders and silencing. You should not rely on the App as your only reminder or for anything safety-critical, and you remain responsible for missed calls or alerts while Do Not Disturb is active.
6.6Live streams. Links to live broadcasts of the Holy Mosques are provided by third-party websites displayed within the App. We do not control their availability, content, or advertising.
7. Accounts
7.1An account is optional; the core features of the App work without one. An account is required only for features that involve our servers, such as the Community, shared circles, Khatm groups, and optional leaderboards.
7.2You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to create an account. A younger child may use the App only through a profile set up and supervised by a parent or guardian (see Section 9).
7.3You agree to provide accurate information, keep your password confidential, and notify us promptly of unauthorised use. You are responsible for activity under your account. Passwords are stored by us only as a secure, irreversible hash.
7.4Account deletion. You may permanently delete your account at any time from within the App (Settings → Account → Delete my account), which immediately removes your profile and the server-side data tied to it, including community posts, circle and Khatm memberships, and any child’s leaderboard entry. You may also ask us to delete it using the details in Section 27; we will process verified requests promptly and within the period required by applicable law, subject to limited retention required for legal, security, or dispute-resolution purposes. Data stored only on your device is removed by uninstalling the App.
7.5We may suspend or terminate accounts that breach this Agreement, in accordance with Section 15.
8. Community Content and Conduct
8.1Where enabled, the Community feature lets signed-in users reply within discussion topics opened by us. Anything you post is User Content, and is visible to other users.
8.2Zero tolerance. There is no tolerance for objectionable content or abusive users. You must not post content that is unlawful, hateful, harassing, threatening, sexually explicit, violent, sectarian or takfiri in nature, that promotes extremism, that is defamatory, that infringes another’s rights, that contains personal information of others, that is spam or commercial solicitation, that impersonates a scholar or authority, or that presents personal opinions as a binding religious ruling (fatwa).
8.3Moderation. Community posts are screened using automated word filters and may be held for review, edited, or removed at our discretion, and without notice where necessary. We review reports and will act on objectionable content within 24 hours where practicable.
8.4Reporting and blocking. You can report any post using the in-app report function, block any member so that you no longer see their replies (manage this under Settings → Blocked users), and flag inaccurate app Content using the content-report tool. We will remove content that violates this Agreement and may remove or suspend the users who posted it.
8.5Your licence to us. You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute it within the App and on our related services for as long as it remains posted, and to moderate it as this Agreement provides. You confirm you have the right to grant this licence.
8.6Views expressed in User Content are those of the individual user, not of the Publisher. We do not endorse User Content and are not liable for it.
8.7Shared features. Flashes, shared cards, and similar sharing tools produce images or links that you may send through other apps. You are responsible for what you share and for complying with the terms of those apps.
9. Children and Kids Corner
9.1Kids Corner is designed to be used by children under the guidance of a parent or guardian. It is intended for use only on a device controlled by an adult.
9.2A child’s profile (name or nickname, age and a chosen avatar) is created and stored only on the device it was set up on. Nothing about it is sent to our servers unless a parent, signed in to their own adult account, expressly opts the child into the optional shared leaderboard, in which case the child’s display name, avatar and points are transmitted and become visible to other users.
9.3By enabling any such sharing, you confirm that you are the child’s parent or legal guardian, that you consent on the child’s behalf, and that you will supervise the child’s use. We recommend using a nickname rather than a real name. Kids Corner does not contain advertising or third-party behavioural tracking, and contains no in-app purchases.
9.4Children must not use the Community feature or create their own accounts. If we learn that a child under the applicable age has created an account without parental consent, we will delete it.
9.5Parents may contact us at any time (Section 27) to review or request deletion of information relating to their child.
10. Device Permissions and Microphone
10.1The App requests certain device permissions, each only for the stated purpose. You may decline or later revoke any permission in your device settings; doing so may disable the related feature but will not prevent you from using the rest of the App. The permissions and their purposes are summarised in Annex B.
10.2Location is used to calculate prayer times and the Qibla direction. This calculation happens on your device and your location is not sent to or stored on our servers.
10.3Microphone. The Tajweed Coach records audio through your microphone only while you are actively using it, so that you can compare your recitation with the reference. Recordings are kept in temporary storage on your device and are not uploaded to our servers.
10.4You are responsible for using the microphone lawfully, including not recording other people without their consent.
11. Privacy and Data
11.1Our collection and use of personal information is described in the Privacy Policy. In summary: most of the App works offline and does not send information to us; optional accounts store the name, email address and hashed password you provide; and if you enable notifications, a device token is registered with Firebase Cloud Messaging so that reminders and campaign notices can be delivered.
11.2To understand how many people use the App and which hosted media is played, the App sends anonymous, aggregated usage signals — a randomly generated install identifier (not a hardware identifier), at most once per day when the App is opened, and once when hosted media is played. This identifier is not linked to your name, account, or contact details, is not used for advertising, and is not shared with third parties.
11.3We do not sell your personal information or use it for advertising, and we do not use third-party advertising or behavioural analytics services.
11.4Where you contact support or submit a content report, we receive what you write and any contact details you choose to include, and use them only to respond.
12. Donations and Free Access
12.1The App may list voluntary ways to support its maintenance. Any donation is made outside the App and outside the Store, directly to the recipient shown, through the third-party method you choose. Neither Apple nor Google is a party to, or responsible for, any donation.
12.2A donation is a gift. It is not a purchase, does not unlock any feature, does not create a contractual, employment, agency, or partnership relationship, and is governed by the terms of the payment method used. Please verify recipient details before sending funds; we are not responsible for payments made to anyone other than the recipients displayed within the official App.
12.3If we ever introduce paid features, we will do so only through the Store’s in-app purchase system and will update this Agreement.
13. Third-Party Services and Links
13.1The App relies on or links to third-party services, including Google Firebase (push notifications and campaign settings), recitation servers (mp3quran.net), third-party live-stream websites, WhatsApp and other apps you use to share, and open-data providers listed in Annex A.
13.2Those services are governed by their own terms and privacy policies. We do not control them and are not responsible for their availability, accuracy, content, or practices. Your use of them is at your own risk.
13.3You must comply with any third-party terms that apply to your use of the App, including your mobile carrier’s data-usage terms. Downloading recitations, or using any online feature, may consume mobile data for which your carrier may charge you.
14. Updates, Maintenance and Support
14.1We may release updates that add, change, or remove features or Content, or that are required for security, legal, or compatibility reasons. Some updates may be needed to keep using the App. Unless we say otherwise, updates are governed by this Agreement.
14.2We do not guarantee any particular level of support, availability, or compatibility with any device or operating-system version. We will make reasonable efforts to respond to support requests made through the App’s Support section.
14.3Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the App. The Publisher is solely responsible for any maintenance and support.
15. Term and Termination
15.1This Agreement takes effect when you first install or use the App and continues until terminated.
15.2You may terminate it at any time by uninstalling the App and deleting your account.
15.3We may suspend or terminate your licence and access, with or without notice, if you breach this Agreement, misuse the Community or other services, or where required by law or a Store. We may also discontinue the App or any feature at any time.
15.4On termination your licence ends and you must stop using and delete the App. Sections 3–5, 8.5–8.6, 12, 16–19, 21 and 24–26, and any other provision that by its nature should survive, survive termination.
16. Disclaimer of Warranties
16.1TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THE PUBLISHER DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.
16.2WITHOUT LIMITATION, WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE; THAT PRAYER TIMES, QIBLA, DATES, REMINDERS, OR CALCULATIONS WILL BE ACCURATE OR TIMELY; THAT CONTENT IS COMPLETE, AUTHENTIC, OR ERROR-FREE; OR THAT DEFECTS WILL BE CORRECTED.
16.3Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in this Agreement excludes rights that cannot lawfully be excluded, including consumer-protection rights in your country of residence.
17. Limitation of Liability
17.1TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PUBLISHER, ITS VOLUNTEERS, CONTRIBUTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THEIR POSSIBILITY.
17.2TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH, AS THE APP IS FREE, IS ZERO) AND (B) [LIABILITY CAP AMOUNT, e.g. USD 50].
17.3Nothing in this Agreement limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.
18. Indemnification
18.1To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Publisher and its volunteers, contributors, and affiliates from claims, liabilities, damages, and reasonable expenses (including legal fees) arising from your User Content, your breach of this Agreement, or your violation of any law or third-party right.
19. Product Claims
19.1You acknowledge that the Publisher, and not Apple or Google, is responsible for addressing any claims relating to the App or your possession and use of it, including: (a) product-liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation.
19.2In the event of any failure of the App to conform to any applicable warranty, you may notify the Store Provider, which may refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, the Store Provider will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty will be the Publisher’s sole responsibility.
20. Intellectual Property Claims
20.1You and the Publisher acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual-property rights, the Publisher, not Apple or Google, will be solely responsible for the investigation, defence, settlement, and discharge of the claim.
21. Legal Compliance and Export
21.1You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
21.2You must comply with all applicable local, national, and international laws and regulations in connection with your use of the App, including export-control and sanctions laws.
21.3The App is “commercial computer software” and any documentation is “commercial computer software documentation” as those terms are defined in U.S. federal acquisition regulations. Use by or for the U.S. Government is limited to the rights granted by this Agreement.
22. Third-Party Beneficiary
22.1You and the Publisher acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement as it applies to your use of the App on Apple devices. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it. This right does not make Apple a party to this Agreement.
23. Store-Specific Provisions
23.1Google Play. If you obtained the App from Google Play, you acknowledge that Google LLC and its affiliates are not parties to this Agreement, have no responsibility for the App or the Content, and are not obliged to provide maintenance or support. Your use of the App is also subject to the Google Play Terms of Service and the Google Play Developer Program Policies as they apply to you.
23.2Apple App Store. If you obtained the App from the Apple App Store, you acknowledge that this Agreement is concluded between you and the Publisher only, and not with Apple; that your use of the App must comply with the Apple Media Services Terms and Conditions; and that Sections 14.3, 19, 20, 21 and 22 apply.
23.3Nothing in this Agreement limits any right you may have under a Store’s terms, including refund rights.
24. Governing Law and Dispute Resolution
24.1This Agreement is governed by the laws of [GOVERNING LAW / COUNTRY], without regard to its conflict-of-laws rules. Where you are a consumer, you also keep the mandatory consumer-protection rights of the country in which you live.
24.2We encourage you to contact us first at the address in Section 27 to resolve any concern informally. Any dispute that cannot be resolved informally will be submitted to the courts of [JURISDICTION / CITY], which will have non-exclusive jurisdiction, except where the law of your country of residence gives you the right to bring proceedings in your local courts.
24.3The United Nations Convention on Contracts for the International Sale of Goods does not apply.
25. Changes to this Agreement
25.1We may update this Agreement from time to time — for example, to reflect new features, legal requirements, or Store rules. Material changes will be notified through the App or on our website, and the “Effective Date” above will be updated.
25.2Your continued use of the App after an update takes effect means you accept the revised Agreement. If you do not accept it, you must stop using the App and may delete your account.
26. General
26.1Entire agreement. This Agreement, with the Privacy Policy and any terms displayed in the App at the time of a feature’s use, is the entire agreement between you and the Publisher regarding the App and supersedes all prior understandings.
26.2Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full force.
26.3No waiver. A failure to enforce any right is not a waiver of it.
26.4Assignment. You may not assign or transfer this Agreement without our consent. We may assign it to a successor to the App or an affiliate without your consent.
26.5Language. This Agreement is made in English. Any translation (including into Urdu) is provided for convenience only; if there is a conflict, the English version prevails, except where local law requires otherwise.
26.6Force majeure. We are not liable for any delay or failure caused by circumstances beyond our reasonable control.
27. Contact Information
